What can be done when a Judge is Bias? We have proof of domestic violence. Judge threatens contempt if mention?

We have been going to court for months on custody of my child with father who I never married. He is also an attorney. It started with my house burning down. The father refused to bring my son back from visitation and went the next day for an emergency temporary custody order. He claimed child endangerment. I had recently met someone and he found out about it and told the judge I was allowing this man to spend the night with my children there. This is an absolute lie but judge will not believe me. I have been ordered not see this man again by the judge or I will loose my child permanantly. .There is a lot of past domestic violence in our relationship with police reports, pictures and audio of threats to my life. He has threatened me many times in front of my child. The judge not only threatened contempt of court if my attorney mentioned it again but, ordered me to parenting class and random drug testing in which the father has convienced judge I am on drugs. Over this past year I have had random drug tests on 40 negatives and 4 hair folicle test randomly done. All have been negative. My doctor prescribed Zanex for anziety due to all my legal problems and abuse. I told the judge about it and the people whom gave me a drug test. The test came back negative.The judge thinks I am altering the test. She ordered 3 more months of it before I can go back to court. The judge let the father sit in the witness stand for over an hour with no interuptions verbally abusing me. She allowed him to put me down and tell her how dumb he thought I was and I couldn’t even cook oatmeal. He talked about I was so uninteligent that I had nothing to offer in conversation. He told the court I was uneducated. I am on my 4th attorney and nobody will help me or stand up to this man or the judge. I feel I will loose my child. I have been in several couseling sessions along with my 12 year old son. He is in a school for advanced studies. This child never had problems until all this.This child is now in counseling because of witnessing abuse and hearing it everyday for several yesrs. He has a different father. Judge will not let us talk about it. I simply don’t know where to go for someone to help me with this nightmare. He has temporary custody and just recently I was allowed to seemy son without supervision. I have spent every dime on legal defenses and work 7 days a week for the past year to pay for all this. If I didn’t know better I would think I was in the middle east countries where they stone women. This judge will slaughter me and my attorney if we report her right now. I simply don’t knowhow I can be heard with this Judge. Is there a way in Oklahoma law to get the court room reporters papers on this case? How can I find out about complaints on a judge or lawyer? Help!!!

In general, when one disaagrees with a judgment issued by a court, the remedy is to appeal. You can get the transcripts by contacting the court reporter and paying for the transcripts. There are also ways to disqualify a judge for bias but in most places that must be done at the earliest moment.

domestic violence case?

My boyfriend and i got into an argument and i bit him in the arm and he broke my car door. I called the cops and told them that he hit me when he didn’t and i also told him i bit his arm. they even took a picture of his arm where there is huge mark. but they arrested him and not me. If we go to court and I tell the court that i should be convicted of domestic violence, what are the chances they would charge me for domestic violence?

There are two questions to consider here: There is the legal question and the ethical question.

Generally, the district attorney won’t file or pursue the case without a willing victim-witness (you). You may never actually go to court but if the DA contacts you, you can tell them your not wiling to cooperate. If for some reason, they want to file anyway and you are required to go to court, you are not required to incriminate yourself. Its possible to deny what he is charged with without admitting that you bit him. If you are asked about biting him you have the 5th amendment right to refuse to answer.

If for some reason you do admit to biting him, is it possible to be charged? Yes. As a matter of fact, if you were going to be charged it would be with a violation of Penal Code 273.5, Corporal Injury to a Spouse or Domestic Partner, a felony. However, the likelihood of this happening is very low. Its just not the way the system works. Your boyfriend is the one charged, so the focus is on him. They actually already have the evidence that you bit him, so if they wanted to file against you by now, they most likely would have.

Now, assuming the worst, that only your admission would acquit him, you have to think about the ethical consequences–perhaps you already have. You, in fact committed a crime and then made it worse by getting another person arrested. If it comes down to it, ethically you have an obligation to take the fall. But that may not be necessary at all in this case.

Despite the other answer, changing your story now is not perjury.

RIHANNA PERFORMS FOR STARS IN LA [HD]

Los Angeles police said they plan to detain R&B singer Chris Brown for questioning in connection with an alleged domestic violence assault against his girlfriend, pop singer Rihanna, according to sources familiar with the investigation.

[Updated 7:25 p.m.] Brown arrived at the Wilshire Division station about 7:15 p.m., accompanied by another man. The pair drove into a parking lot behind the station on Venice Boulevard, east of La Brea Avenue, in a black Escalade. Brown and the man entered through a back door where a posted sign stated for authorized personnel only. Police are expected to release a statement later this evening

Brown and Rihanna canceled their performances at tonight’s Grammy Awards.

The incident is being investigated as a felony domestic violence case, police said. It was reported about 12:30 a.m. Sunday in Hancock Park.

Brown and Rihanna, whose full name is Robyn Rihanna Fenty, were apparently in a car together and got into an argument on North June Street, according to a Los Angeles Police Department statement. Brown stopped the car, the two got out, and the argument escalated, according to police.

A witness called 911, but Brown was gone when officers arrived at the scene. The woman suffered visible injuries and identified Brown as her attacker, according to police.

Brown and Rihanna had appeared together Saturday night at Clive Daviss pre-Grammy gala in Beverly Hills.

Shortly before the Grammy show began at 5 p.m. at Staples Center, Grammy officials issued a statement saying, “We have just been informed Rihanna will not be attending tonights 51st Grammy Awards. Rihanna will not be performing. We are sorry to see she is unable to join us this evening.

A publicist for the Barbados-born star, who sold more digital song downloads than any other in 2008 with nearly 10 million tracks, said Sunday night, Rihanna is well. Thank you for your concern and support.

Her song Disturbia, which shed been scheduled to perform at the ceremony, was the sixth best-selling digital track of the year. She was replaced by veteran soul singer Al Green, who was accompanied by country singer-guitarist Keith Urban.

california domestic violence law,what happens for a first timer?

my son is going through a devorice and lost his temper and pushed his ex-wifes glasses against her face causing a mark. pictures were taken and i dont look at this lightly, but he has a past criminal record . this is a first and last time offense. what will happen to him in the san bernadino california area.i also need help finding a place to recommend to him for in-house treatment for a chemical imbalance treatment facility also in the S.B. county area. please help me and dont judge.

I have training and knowledge in California law, perhapes I can help.

California Penal Code 273.5 is a Felony Domestic Violence, which shows the intent to cause injury, which is usually what you’re charged with in a Domestic Violence with injury, which is this case.

273.5PC states it’s willful, but the arguement and him losing his temper is enough "willful intent." It sounds to me that she had a mark, which qualifies as "Corporal injury" and satisfies 273.5PC.

I’d like to be on your side, but it looks like he’s looking at a conviction of 273.5PC Domestic Violence with Corporal Injury, however getting convicted is up to the jury/trial.

ANY slight injury, whether a bleeding stab, or a pink slap mark, is 273.5PC and Felony. I hope for the best!

Domestic violence case… what will happen to me?

have been in an unhealthy relationship now for a while. A long time ago, my boyfriend and I got into a physical altercation to where he gave me a bloody nose and I took pics, and filed complaints at the time, but realized I was sooo intoxicated it was not fair to put it all on him. So we got a lawyer and got dismissed. But just a week ago we got into another altercation, but this time it was me! The first time ever in handcuff and I am devastated! We had been drinking, AGAIN… and he said something to set me off, and I pushed him on the bed and his necklace was ripped in the process. He called the cops and I got taken to jail. I did not have to pay bond or anything though. I lied to the cops and said I didn’t do anything because I was scared. He does not want to prosecute, and is willing to cooperate, and I am even going to go back to my parents (10 hours away!) once this whole thing is settled. He does not wish to prosecute, he wants this all to go away. There were no pictures taken, no extensive reports… All he filled out was a card that said "I was pushed on the bed and in the process my necklace got ripped off". There were no marks, or anything. No clothing ripped, and his necklace is fixed. I am getting an attorney. I am just so scared. We live in VA if it helps. Please, any advice will help.

Is this how you want to continue to live your life? Sounds to me as if you both have a drinking problem. As far as criminal charges, make sure everything is dropped/cleared up before you dump your bf and try to heal yourself.

At this point if you hook up with another guy, he will just be the same scenario, different face and name. Try some counseling and soul searching. Good luck

TMZ has just release the photo pic of Rihanna being abused by Chris Brown. This is shocking and sad

A photo that shows Rhianna bruised, bloodied and battered is the real thing, and it’s “terrible,” the pop singer’s father said today

“Yeah, I saw it,” Ronald Fenty told Usmagazine.com. “It’s disturbing.”

His daughter, born Robyn Rhianna Fenty — 21 years ago today — allegedly suffered the abuse on Feb. 8 at the hands of her boyfriend, singer Chris Brown.

“It’s good and it’s bad to see the picture because there’s other people who were thinking differently, that [Rihanna's injuries] may not be that bad, just a little spank or a little thing,” said papa Fenty, who confirmed that the shot was definitely of his daughter.

The photo was leaked to the gossip website TMZ.com, and Los Angeles police are currently investigating how.

Rihanna’s face is bruised, swollen and battered and her lip bloodied in the shocking pic that purportedly shows the aftermath of an alleged beating she suffered at the hands of Brown, according to TMZ.

The harrowing close-up image a welt above each of the woman’s eyebrows, marks on her cheek and around her lips, and general swelling. TMZ did not say how it obtained the photo, when it was taken or by whom.

Hours after the photo was posted, the Los Angeles Police Department launched an internal investigation and asked for the public’s help in finding the person who leaked it. A police news release said the image “has the appearance” of one taken during a domestic violence investigation, and classified its release as a case of serious misconduct that could result in termination.

Asked earlier Thursday whether he could confirm the photo’s origin, LAPD Officer Jason Lee said only that the department had not released images of the woman who accused Brown, and would not release evidence photos. A spokeswoman for the district attorney said all evidence related to the case was still with police.

Brown was arrested Feb. 8 and booked on suspicion of making felony criminal threats to a woman that authorities have not publicly identified.

Prosecutors have asked police to provide more information before deciding what charges, if any, to pursue against Brown. Police have said the 19-year-old singer could face domestic violence charges if prosecutors think they are appropriate.

An Associated Press photo of Rihanna, taken before the party on the night of the incident, shows her with a tattoo of Roman numerals on her left shoulder; the TMZ photo shows the same numerals on the same shoulder. TMZ had previously used its site to debunk a manipulated image that depicted Rihanna with a black eye.

No public statement has been issued on behalf of Rihanna, who turned 21 on today.

Brown released a statement on Sunday, which read in part, “Words cannot begin to express how sorry and saddened I am over what transpired.” The statement, which did not mention Rihanna, said Brown was consulting with loved ones, his mother and pastor.

Brown’s arrest came roughly 18 hours after he and Rihanna left a pre-Grammy party honoring music mogul Clive Davis. According to police, Brown and a woman were involved in an altercation in a car traveling through the upscale Hancock Park neighborhood shortly after midnight. Police have said the woman had visible injuries, and that Brown was gone from the scene when they arrived.
