February 242010

Some lads are quite weddy and some women are quite manly so it would be possible. But could the bloke win?

Could you translate that to American? Just kidding. Well, a guy would need to get an erection, so wouldn’t that imply consent?

Yes he could press charges. Its rare but not totally unheard of, just like spousal abuse by the wife. Only way he could win is if he had hard core evidence which I’m sorry to say would be very hard to get therefore the rape vertually impossible to prove it took place.

    Depends on where you are.

In the US, most rape convictions against women involve rape against another woman or against a minor. However, men have prevailed in some cases where they were clearly badly assaulted as well. There really are predatory women, but it’s pretty uncommon.

Why not. I could see others point a man would have to get an erection but some guys can get an erection from a stiff breeze. Its a little bizarre but crazier things have happened.

    YES!

From the answers from women on here I have to say, if a man gets an erection then it is not considered rape, this would also apply to women getting wet? Rethink your answers!

It’s possible but unlikely. You would more likely get some type of sexual misconduct to stick. Men really can’t be raped by a woman without some kind of arousal.
    Correct me if I’m wrong.

The offence of rape is when a man has sex with a woman without her consent or reckless as to her consent and penetration takes place. That could be anally, orally or via the vagina. A man can also rape another man either anally or orally. If a female is present when a man is raping another man and is aiding or encouraging the rape, she can be charged with being concerned in the rape and be tried convicted and sentenced as a principal offender.

I have no doubt that the defence would argue that if he got an erection, he must have been in agreement. If you turn this argument around, however, and a man has an erection, why can he be charged with raping a women? If biology is the determinant, then men can’t help it, contrariwise, women can.

There are cases of woman raping man. There are many sex starved women also in this world. But man may not be able charge women as rapist,at the best case can be filed against physical assault. In fact any sex with out mutual consent is forced sex or rape, whether it is by man or woman.

Depends what country your in .In England rape is clearly defined and must involve penetration of a female so no.The offence of sexual assault is different and as always been considered serious in England carry 10 years imprisonment which is on a parr with rape anyway so this would most likely be charged or a charge of gross indecency.Until recent years sexual assault on a female(not rape) carried 2 years sentence and 10 years on a male!

  42. stags.breath Says:

Sorry frankturk, that is out of date. In the UK, rape is the penetration by a penis of another person by way of the vagina, anus or mouth. So the answer to the question really depends on whether the woman has a penis. The only possibility is being an accessory who held down a person who was raped by a man.

  43. Shaun C Says:

Not likely, to get a criminal conviction there has to be guilt beyond all reasonable doubt. The fact that a man gets an erection is deemed to be an indicator that he is willing to engage in intercourse, it is thus near impossible to satisfy the court that rape occurred.
