dropping charges/Domestic Violence?

My boyfriend and I had a domestic dispute. He had marks on his face he had bruises and a fat lip but he didnt take any pictures and he refused to go to the hospital. Can the State pursue charges if the only thing they have is a police statement? Thank you :) Do you think if he drops charges the prosecutor will more then likely throw it out? because the evidence is not overwhelming, and the cops would not listen to a word any of us tried to tell them. we tried to explain the situation and they just kept saying that we are all liars. Also the gave my boyfriend a paper to sign (it might have been the police statement) and they wouldn’t let him read it they rushed him to sign it. I dont know what to do because its the police words against ours.

There is a Federal Mandate that allows officers to file charges on behalf of the state. Even if he wants to drop charges it most likely will not be dismissed because he is not the complainant the officer is. This mandate was put in place to move forward with the charges because of a trend in domestic violence cases where the battered would come in and drop charges due to threats or intimidation. Now that is not to say that it couldn’t be dismissed but that depends on each individual prosecutor. If he had visible injuries they had to come somewhere unless he plans to go with the "I fell" routine. Officers hear those excuses from battered women all the time and are ignored due to the mental aspect of Domestic Violence ie: woman or man making excuses for the batterer. Domestic violence is a very serious issue and you really need to get assistance from a professional to get your anger under control. If you got so mad at him you resorted to violence as a means to settle the issue then you need some help. I am not saying you are a bad person, I don’t know you but if you are resorting to fists then you have some issues that need addressing.

Domestic violence police reports can I get full custody?

I am going to court in Jan. I am trying to gain full custody of my son. I have pics of his being dropped off dirty (clothing and body) her dropping him off giving him prescribed medicine thats is his borhters (pic) the construction zone she let him play in in turn he fell and had to go to the ER because he split his head open. I have written statements from mutiply people explain the way her house looks inside and that she goes out and parties and leaves him with people and doesn’t inform me or ask me to watch my son when it is court ordered to do so. She is currently under investigation for FRAUD because she has acches insurance but I also have full coverage insurance on him which was court ordered for me to do but she didn’t tell acchess of the other insurance she has and never informed the dr. I have a letter from the dr and also printed out my insurance history (which has the number of claims and how long I have had insurance active on him) She is under investagation as we speak for insurance fraud. And then I have 6 diffenernt domestic violence police reports. Some are verbal a few have been physicall. I only know of these because my son comes over and tells me the cops came and took her other baby daddy away then I go and check the police station and there is reports. He even tells us it scares him. They are all aganist her attacking her ex boyfirned who is the father of the other child. The judge told us at the last hearing that if she keeps coming to court with issues she will lose custody of her son. Do you think I have a good case? To obtain full legal and physical custody?

The circumstances you described a pattern of "child neglect" and and environment that could be potentially abusive for the child.

You would be better off suggesting to the judge that ex have "supervised" visitation. Given that the judge has already hinted at the issues, you have a good chance of gaining custody.

Mass punishment mandatory in the Army? How would you seriously handle this situation?

I’m in the Army, obviously. My rank makes no difference. I consider myself a good soldier. What I don’t get is the mass punishment ordeal. To me it would and is bringing down our morale here. I would get it…..if it was effective. But it is NOT. Its the same individuals that mess up. In a VERY short amount of time since we’ve had 3 DUI’s, 2 or 3 inappropriate conduct between soldiers and other soldier spouses, 3 domestic violence/threats. Theres got to be a better solution. I say….give them 45 days of extra duty, and chapter these dirt bags out! Its hard to stay motivated when you got dirt bag soldiers acting up…..a good majority are the younger soldiers. There’s got to be better solution then what my higher enlisted and XO are/is enforcing. If you have some realistic solutions….please let me know. I’m tired of this already. I like my MOS, my post, just not certain individuals.
Not to mention that certain soldiers that are causing trouble dont get punished the same way. To me it should be the same across the board. How hard is it to do "the right thing"? I dont know. I have only been here for 1 month and my units been here for about 3 months almost. And what makes it worse is that we are only at 45%….we still have more soldiers coming.

hey soldier, i completely understand AND agree with your entire point and logic. HOWEVER, it is the army way, for better or worse. mostly worse. i don;t feel the the violators get the proper punishment and the good kids are busted for something they didn’t do. i can explain how things can get better and what the point behind the whole grouop process really is..

the point is to foster teamwork and unity. this is achieved through self policing by the group. the group– by being punished as a whole — is angry and feeling that the command is unfair. this unifies the group by making the the command the common enemy. US against THEM
WE have got to SHOW THEM that we aren;t the low life scumbags that THEY treat us like. so you band together and excell the prove THEM wrong.

now having said that how do you go about the self policing of the problems. there is a little known army training manual FM22-102
wall to wall coulseling. look it up you can find it on google or at squadleader.com a quick summary is, take the offending party to a remote (private) location and have a "convincing" conversation from the group to the offending party letting them know that from now on, the drill SGT is the LEAST of their worries when they mess up. the group is NOT going to put up with the F ups any longer and they have a choice of becoming squared away or GETTING squared away. let me know how it goes and GOD speed soldier

I have to write a violence against women video review for my sociology class and i’m having trouble figuring out how the functionalist theory and the conflict theory would explain the subject. Any help is greatly appreciated! thanks

a)Functionalism:
social order/ balance and imbalance between social change and social order/functions of institutions/functional alternatives/ strain theory of deviance/subcultural theory of deviance

b) Conflict theory, including gender analyses:
power/ inequality/contradiction/ideology/
hegemony/hegemonic masculinty/connections between changes in the poltical economy and in the family/change
and individual agency

a) and b) social construction of ‘the individual’ and of ’social institutions’

Focus within the topic:
a) Functionalism: relationship between dysfunctional families and specific sub cultures/strains on individuals generated by the wider culture between goals and means of achieving those goals

In your opinion, does this help or hinder the story? What is the purpose of this chapter? (This is your interpretation; don’t feel you have to have one right answer.)

2. In Chapter 16, Janie becomes acquainted with Mrs. Turner, a mulatto who is disdainful of the African American race and culture. She believes it is the duty of all mulattoes (such as herself and Janie) to lighten up the race. What do you think her attitude says about her feeling for herself? Explain why you feel this way.

4. In chapter 17, Tea Cake does something that is uncharacteristic of him: He beats Janie in an effort to show others that he has power over her. What motivates Tea Cake to react this way? Don’t fight it and DO NOT kick them in "the nuts". That makes them angry and if they have a weapon they WILL use it. Rape is not a crime of sex, it is a crime of control/of power. It has nothing to do with the rapist being "horny". The rapist is going to MAKE you do what he/she wants based upon their power and their control over you. You stand a better chance at coming out unscathed if you just lie there.

The arrest of Golden Beach’s town manager comes on the heels of a CBS4 News investigation last month that revealed police Lieutenant Robert Barrio has been allowed to continue working, despite felony domestic violence charges pending against him. Barrio is accused of kidnapping, false imprisonment and battery in an attack on his wife last year in Alachua County. Diaz and Golden Beach police chief Jim Skinner came under criticism from some town residents, and from experts on domestic violence, for not suspending the cop.
