Will I actually be charged with domestic violence?

March 312010

Last Wednesday, I went home after work and found that the house was locked. I called my mothers phone several times. My brother answered it and had no idea who I was. I knew that he was at the bar, but I didn’t know which one. When I asked him where he was, he wouldn’t tell me. He was acting really rude on the phone and I felt like he had something against me to begin with. So I went to the closest bar and he was there with my mom. I pushed him when I walked in (had he not been drunk off his *** and completely unexpecting, he wouldn’t have fallen) So I took my mom’s phone (it’s on a plan with my phone and because my brother uses it I’m short on minutes at the end of the month. it wouldn’t be a big deal if my brother was my age, but he’s 37 with two kids he barely supports) and the house keys and I went home. When they got home my brother got in my face like, you wanna fight? And I’m like… no I really don’t. I tried to walk around him and at first he wouldn’t let me but I managed to get past him. I got a little bit further to my mom and she cornered me and held me against the wall by my throat. I couldn’t even do anything to her so I just started yelling. My brother said, don’t you yell at my mom and he slapped me in the face. So I hit him in the head, apparently leaving some scratches. Then I went in my room and locked the door. My mom broke in with a credit card, cornered me and demanded her phone. I wouldn’t give it to her so I squeezed past her and walked out of the room. While I was on the way out the door, she yelled to my brother, TERRY CATCH HER! He caught me and THREW ME ON THE FLOOR LIKE A MAN. He then proceeded to kneel on me, hit me, kick me, punch me, slap me, spit in my face, etc all while my mom was kicking me in the head. He left bruises, scratches, bumps, marks all over my body. All of these things I have pictures of, by the way. Then he sat on me while he got on the phone with the police. When he got on the phone and I started screaming that he was sitting on me, he got off. Then I went outside to call the police and tell them my side of the story. The police told me over the phone that I sounded like I was the problem. So when they got there, they didn’t even ask me what my side of the story was, but they went inside and talked to my mom and brother about their sides of the story together. Then they came outside, didn’t give me the opportunity to talk and they decided to arrest me immediately. I also was not read my rights. My mom has no marks to speak of, my brother has a scratch on his forehead and a bruise on his shin, apparently), but I have way more marks on myself than they have on them. My brother has two domestic violence counts against him which is why I believe that he sat on me while he called the police and demanded the phone. I think if he hadn’t abused me and didn’t think that I was gonna call the cops, that he wouldn’t have demanded the phone from me and tried to act like he was the righteous one. But anyway, those are my personal thoughts. Please tell me what you think.

Thank you. Sorry this was so long.
I don’t know how young is considered young, but I am 22.

I think you should just say they both beat you leave it at that…
I gather you are young but you should ask the court for representation.

Chris Brown and Rihanna history with physical violence in family.?

March 312010

http://www.askmen.com/celebs/entertainment-news/rihanna/rihannas-brother-war.html
Rihanna has a history of violence with her younger brother.
Plus she said in an interview how her parents used to argue a lot.

http://www.astrochicks.com/2009/02/10/chris-brown-did-his-step-father-abuse-his-mother-growing-up/
Chris Brown mother was in a domestic violence relationship.

Have to wonder about their tempers.

It’s interesting that you raise this. I was remembering what I’d read about Rihanna’s upbringing, which seemed pretty troubled, and I always just thought it was nice that she’d found fame and success and had seemingly risen above all that. It just makes this incident even more sad.

Pre-Employment Screening Problems – Background Check?

March 312010

I have a dilemma – I’m an experienced IT Project Manager with extensive Fortune 500 experience – a high achiever with excellent education and professional credentials – but I have a career problem. In the midst of a high-conflict divorce my ex alleged that I grabbed her arm – and I wound up eventually pleading no contest to the charge of simple battery (PC 242). I was innocent – and the victim of her drunken rage – but nothing I could say or do seemed to matter. The more I protested my innocence, the more legal pressure I was subjected to. In the end, I was blackmailed by the legal system into pleading guilty to something – anything so they would lift restraining orders that forced me to move out and have no contact with her or my kids. The moment I plead "no contest", they lifted the restraining orders and sent me on my merry way – but with a criminal conviction that now prevents me from getting hired. The unfairness, inequity, and humiliation I was subjected to was beyond reason – and now to add even further injury, I am seemingly unemployable – by any firm that conducts background checks. The divorce and legal costs have left me with no significant assets, and I can’t last 2 years without a source of income. I’m looking for advice – a solution to my dilemma. Perhaps a firm that would be willing to hire me despite this issue – and I can and will substantiate my outstanding character, honesty, and integrity. Maybe a strategy to remove this from my criminal record and/or background reports. Maybe a law enforcement organization that would be willing to “clear” this in exchange for assistance in an investigation, sting operation, or other law enforcement activity. I’m open to suggestions – and I welcome and appreciate any helpful guidance or advice. I’m not a batterer trying to squirm out my predicament – I am an honest, kind, helpful person that was victimized by a person with very serious emotional issues (bpd, depression, and alcoholism) and a legal system that assumes all allegations are just, true, and above challenge. Thank you for reading this, and I encourage you to educate yourself on the dysfunctional state of California’s domestic violence laws. I’m opposed to violence (domestic or otherwise) in every way – but the current legal system is being abused and manipulated in a well-intentioned but misguided effort to prevent further suffering my women. It is a noble and righteous goal – but the results have not been realized and many men have suffered the same fate.

every city and state has what we call legal aid which is free attornys find out where your is located and go and personally talk to them and they will help you and or give you the correct way to remove or block it from employers or wait seven years which is easier for you.

Why do Americans continue to believe that women are more discriminated than men?

March 312010

Many people would say that American women are more discriminated because they get paid less than men and are not in as much high positions are men but I think that overall both women and men are in the same boat.
1. Women have equal fundamental rights to vote, run for office, go to college but are not required by law to sign up for selective service.
2. States that have the death penalty are very reluctant to send a woman to death row even if the crime was a capital offense. Male offenders who are charged with statutory rape are discriminated over and over again when women like mary kay letourneau and debra lafave sleep with underage boys and get probation for their first offense.
3. Child custody and divorce laws have been shown to favor women.
4. It seems that society and the law tends to see sexual harassment or domestic violence against men less serious than against women.

"Where women are more at a disadvantage is because 1/2 of families are being raised by sinlge mothers. MEN DUMP KIDS ON WOMEN. Thats what holds women down"

You fail to realize the fact that women, in 90% of the cases, are granted legal custody of the children – hence why the number of single mothers outweigh the single fathers. A father can’t just request that he becomes the legal custodian; it’s decided by the courts, and overall its balanced in the favour of women, since women are deemed the ‘primary caregiver’ by law and society. The OP even pointed this out; didn’t you read? IMO, men are far more disadvantaged than women, since they can lose their children, their assets; house, cars etc, forced to pay child support and alimony for 18 years. This is only one aspect of the kind of injustices men face in this feminist age.

"Advantage is HIGher salaries, more mobiliyt, more freedom, more power, more respect"

How does this constitute discrimination? We have economic equality, hence the Equal Pay Act – this is backed up by state and federal law. If you’re pertaining to the fact that, on the whole, men earn more, this can be justified by the following:

"First, the sheer amount of work. According to the Bureau of Labor Statistics, full-time men clock an average of 45 hours a week, while women put in 42 hours. Men are more than twice as likely as women to work at least 50 hours a week – that’s why most CEOs are male.
Only in a socialist economy do employees get paid the same, regardless of the number of hours worked.

Second, men tend to gravitate to the socially-unrewarding but lucrative fields like computer programming, tax law, and engineering. And women select professions such as teaching, nursing, and social work that pay less, but offer more job flexibility.

Third is job desirability. Recently the Jobs Rated Almanac rated 250 jobs based on income, work environment, physical demands, stress, and so forth. These were the five worst jobs: seaman, ironworker, cowboy, fisherman, and lumberjack.
Does it come as a surprise that all of these jobs are male-dominated? The only way these companies can attract men to do the dirty work is to increase their paychecks.

Finally is the difference in job hazards. Men represent 92% of all occupational deaths. Why? Because if you look at a list of the most hazardous occupations – fire fighting, truck driving, construction, and mining – they have 96-98% male employees, according to the Bureau of Labor Statistics. Shouldn’t men who risk their lives on a daily basis be paid something extra? " Corey Roberts

"The second point is the PORN industry. Women are sold for sex."

Women CHOOSE to sell themselves for sex – nobody forcing them to do it against their will. Therefore, they are not being "discriminated" against men. What a glaring logical fallacy.

"The third point is violence against women as seen by the hundreds of male serial killers. the rapists, the mutilators, the child molesters. "

What about violence against men – or doesn’t that matter, b/c they’re only "men"? Naturally. Do you realize the number of men killed far outweigh the number of women? Sure, more women are raped, but more men are murdered than women. Men are 5 times more likely than women to be murdered and 3 times more likely than women to be the victims of other violent crimes. But, still, we have the VAWA act – I don’t hear about any other similar legislation being enacted in favour of men

THERE ARENT LOTS OF THINGS. you are not seeing the big picture: women are the most pampered and privileged demographic in the Western world.

Real life horror stories about domestic abuse against women by there husbands/lovers?

March 312010

I need real life experiences. I’m writing a paper for college and it can be as truthful as possible meaning as graphic you might say to make a point. I had to choose from 20 diff types of problems this hit close to home because my aunt was abused by her second husband but I’d rather not ask her about it. Any comments would be most helpful.

My mother had an alcoholic boyfriend for years, who many times while drunk abused her in front of her children and also abused the children. He held a butcher knife to her neck one night and threatened to throw me out the window. She’d break up with him from time to time, but he’d get drunk and come back and she was so afraid of him that she’d let him stay. On another night when he was drunk he kicked our dog, which prompted my sister’s husband to wrestle with him. While that was going on I took advantage of the situation to beat his back with a high heeled shoe. I was then 10 or 11. I am now 59 and and if I ever ran into him I would beat him to death with no remorse. He would be in his 80’s.

Is this correct yes or no?

Have Anti-Father Family Court Policies Led to a Men’s Marriage Strike?
By Glenn Sacks and Dianna Thompson

Kathleen is attractive, successful, witty, and educated. She also can’t find a husband. Why? Because most of the men this thirty-something software analyst dates do not want to get married. These men have Peter Pan Syndrome–they refuse to commit, refuse to settle down, and refuse to "grow up."

However, given the family court policies and divorce trends of today, Peter Pan is no naive boy, but instead a wise man.

"Why should I get married and have kids when I could lose those kids and most of what I’ve worked for at a moment’s notice?" asks Dan, a 31 year-old power plant technician who says he will never marry. "I’ve seen it happen to many of my friends. I know guys who came home one day to an empty house or apartment–wife gone, kids gone. They never saw it coming. Some of them were never able to see their kids regularly again."

The US marriage rate has dipped 40% over the past four decades, to its lowest point ever. There are many plausible explanations for this trend, but one of the least mentioned is that American men, in the face of a family court system which is hopelessly stacked against them, have subconsciously launched a "marriage strike."

It is not difficult to see why. Let’s say that Dan defies Peter Pan, marries Kathleen, and has two children. There is a 50% likelihood that this marriage will end in divorce within eight years, and if it does the odds are two to one that it will be Kathleen, not Dan, who initiates the divorce. It may not matter that Dan was a decent husband–studies show that few divorces are initiated over abuse or because the man has already abandoned the family. Nor is adultery cited as a factor by divorcing women appreciably more than by divorcing men.

While the courts may grant Dan and Kathleen joint legal custody, the odds are overwhelming that it is Kathleen, not Dan, who will win physical custody. Over night Dan, accustomed to seeing his kids every day and being an integral part of their lives, will become a "14 percent dad"–a father who is allowed to spend only one out of every 7 days with his own children.

Once divorced, odds are at least even that Dan’s ex-wife will interfere with his visitation rights. Three-quarters of divorced men surveyed say their ex-wives have interfered with their visitation, and 40% of mothers studied admitted that they had done so, and that they had generally acted out of spite or in order to punish their exes.

Kathleen will keep the house and most of the couple’s assets. Dan will need to set up a new residence and pay a substantial portion of his take-home pay to Kathleen in child support.

As bad as all of this is, it would still make Dan one of the lucky ones. After all, he could be one of those fathers who cannot see his children at all because his ex has made a false accusation of domestic violence, child abuse, or child molestation. Or a father who can only see his own children under supervised visitation or in nightmarish visitation centers where dads are treated like criminals.

He could be one of those fathers whose ex has moved their children hundreds or thousands of miles away, in violation of court orders which courts often do not enforce. He could be one of those fathers who tears up his life and career again and again in order to follow his children, only to have his ex-wife continually move them.

He could be one of the fathers who has lost his job, seen his income drop, or suffered a disabling injury, only to have child support arrearages and interest pile up to create a mountain of debt which he could never hope to pay off. Or a father who is forced to pay 70% or 80% of his income in child support because the court has imputed an unrealistic income to him. Or a dad who suffers from one of the child support enforcement system’s endless and difficult to correct errors, or who is jailed because he cannot keep up with his payments. Or a dad who reaches old age impoverished because he lost everything he had in a divorce when he was middle-aged and did not have the time and the opportunity to earn it back.

"It’s a shame," Dan says. "I always wanted to be a father and have a family. But unless the laws change and give fathers the same right to be a part of their children’s lives as mothers have, it just isn’t worth the risk."

According to data supplied by the U.S. Census Bureau, there were 2,395,000 marriages in the U.S. in the 12 months ending June, 1997 (and 1,154,000 divorces in the same period). The 4,000 to 6,000 marriages involving international services represent, then, a tiny portion (.021 percent) of the women who marry U.S. men.

It is interesting to note that, based largely on data provided by the agencies themselves (along with the Commission on Filipinos Overseas report cited above), marriages arranged through these services would appear to have a much lower divorce

so that is why i CANNOT find any guys my age!!!

Can you show me a verse in the Bible that is against rape?

March 312010

And one that isn’t against the rape victim.
Not trying to be contradicting, just trying to find one.
Other than the obvious one of if you’re not married. Assuming you are married to the person, the bible would be okay with you raping them?

If you are looking for a verse on how sexual relations are to be conducted within a marriage, 1 Corinthians 7:1-5

1Now for the matters you wrote about: It is good for a man not to marry. 2But since there is so much immorality, each man should have his own wife, and each woman her own husband. 3The husband should fulfill his marital duty to his wife, and likewise the wife to her husband. 4The wife’s body does not belong to her alone but also to her husband. In the same way, the husband’s body does not belong to him alone but also to his wife. 5Do not deprive each other except by mutual consent and for a time, so that you may devote yourselves to prayer. Then come together again so that Satan will not tempt you because of your lack of self-control.

So according to the Bible, a husband is to treat his wife with the same respect that he would treat himself. And the wife is to treat the husband the same way. The act of raping the other person would be a violation of that rule.

LAPD investigates Rihanna photo leak
Rihanna

The Los Angeles Police Department has launched an urgent inquiry into the leaking of a photograph showing the battered face of the Barbadian pop star Rihanna after an alleged attack by her boyfriend, the singer Chris Brown.

The photograph, posted last night on the celebrity gossip website TMZ.com, shows the former beauty queen’s face covered with bruises, scratches and swelling. The close-up shows a welt above each eyebrow and marks on her cheeks and around the lips.

TMZ did not say how it obtained the photo, when it was taken or by whom, but the LAPD immediately launched an internal investigation and said that it “has the appearance” of a photograph taken during a domestic violence investigation.

Mr Brown, 19, was arrested on February 8 and booked on suspicion of making felony criminal threats after an altercation with Rihanna at a pre-Grammy party.

Rihanna, who won a Grammy for her mega-hit Umbrella last year, turns 21 today.

In line with its policy, the LAPD has not identified Rihanna – whose real name is Robyn Fenty – as the victim of the alleged assault and did not mention her by name in last night’s statement.

The photograph published by TMZ clearly shows a tattoo of Roman numerals on her left shoulder identical to a “bonding tattoo” the singer has which shows her best friend’s birthdate.

The LAPD said in its statement that it took seriousy its “duty to maintain the confidentiality of victims of domestic violence” and had launched an immediate internal investigation into the leaked photograph as well as filing a “personnel complaint”.

“A violation of this type is considered serious misconduct, with penalties up to and including termination,” it added.

The Department asked members of the public with information about the leaked photograph to contact them.
